Ebay Seller welching on our deal..what to do? -

Bought an item for a great price of ebay, but the seller is welching on the deal. He's being slow to respond, and keeps giving BS stories how he just discovered one part is damaged and returned my 1st payment. I said I wanted it anyway, maybe just give a slight discount (to test his BS.) He finally writes back that he's not interested in selling it now, but may try to resell it later. (too bad bitch it's already sold....)
The deal closed relatively low, but I think he thinks its worth way more than it sold for (tried to sell it for really high min before and had no bids) and is just trying to sell it again later for hopefully more.
Regardless, I still want to get the item, and I'm really pissed he's wasted my time so far. Plus welchers are suck and at this point I might as well F with him for as long as I can before I slam him w/ a - rating.
At the end of the day, I can't force him to put it in a box and send it. What else can I do thru ebay? Got any other ideas for giving him $h1t? Thinking about repaying again (cc paypal), then opening an unsent item dispute... and I'll set it up to watch him and if he relists the item not as being previously "defective", I'll report it to ebay as such and have all the messages which has him describing it as such.
Anyways... I'm pissed.

I would contact ebay! Even though he returned your money he backed out of a contract! Once the item has sold it is SOLD!!! He says it's defective, you say send it anyways, it should be on your door step! Any chance you can make us aware of who this is so we don't buy from him? What was the item? Good luck!

Yep, make payment and then open a dispute thru paypal.. Most likely you will get your money back. You can contact ebay about it too. Maybe they can do something...
If I may ask, what was it? A "near mint" inflatable friend?

Well it was sold as near mint, but he's saying it now has "airleaks" and he's not sure how the new holes got there. Regardless, most of the ones you find are blonds, and I much prefer this one. Brunette with a bit of color, a rarity. I am quite skilled at patching them up, and usually bigger holes than the needle pricks he put into it at that. ;)
Otherwise it also came with a subwoofer to replace the one that got stolen out of my car a couple weeks ago. Thought I found a great deal to get some bass back in my car and this MFer is pulling this crap. I was in a bad mood about it to begin with, so now someones going to pay....

honestly, I don't think ebay will do anything. you can litigate the matter but it's not worth it.
post his ebay id. everyone here with an ebay account can e-mail him telling him what's up. give me his number, I'll call him as a very convincing and threatening "lawyer"!

There isn't much you can do about sellers remo remorse - If you've got your money back you can either leave negative feedback in which case I'm sure you will get a neutral which you will have to fight with ebay to have removed...
Personally I've had it a couple of times and just move on... It isn't worth it...

Ebay/Paypal will do nothing for you other than to get your money back, they will not help you get the actual item or an equivalent item, which I think its total BS! I have had the same thing you described happen to me twice now and both items were a steal and both times the seller backed out. The one even went as far as saying that the items were burned up an a house fire and linked to some fake news article. Its too bad because in both cases I wanted the item not the cash and ebay wouldn't do squat for me, I even suggested that they buy out a buy it now auction for me and give me that item for the price I paid, but they wouldnt go for that!

Yeah, at the end of the day I know there is no way I'm going to get the item if he's not willing to send it. I do just want to harrass him as much as reasonable possible for being a dbag. I think I've decided not to pay again, if he doesn't return the funds willingly, I don't want the hassle of going thru paypal to get them. I am going to tell him I want the item as is at the sell price and see what BS he comes up with, file a dispute when the 10 days have passed, then eventually call him out and watch his ass for the relisting and notify ebay as a fraud item as I know he won't list it as previously defective and repaired (claims the voice coil in the woofer is "damaged," but he will fix it for resale in the future... No way he is fixing a voice coil.)
Basically I want to be as big of PITA as possible so he knows it wasn't worth the extra couple bucks he may have made by welching and reselling. Haha, he posted that he hopes there are no hard feelings and he won't get a - rating. He can try and retailiate, but I have plenty of messages from him to back me up (written very diplomatically by me as well) and a prompt payment, so there is no possibilty of complaint against my end.
I figure if no one is ever willing to post - ratings, bad traders don't get ID's and they continue to screw other people over.

So I made several attempts to work things out w/ the seller. It was always my suspicion that he was trying to back out on the deal cuz he thought the item was worth way more than the close. He made up some story about it being damaged, but still refused to sell it either discounted, or later for the full price as-is. There is no logical reason to refuse the latter. Basically I was very diplomatic and courteous and just fed him rope to hang himself.
After the last offer to buy it in-full as-is, I reported his lying ass to fleabay and they track all the emails going back and forth. He was being a [Cheney] the whole time, but then got smacked down by ebay. The email from CS is great. I get to leave feedback (hahaha,) released from buying the item, and he will minimally not have his listing fees refunded and is still responsible for the Final Value Fee. The last part is the important part. If you, as a buyer, agree to cancel a transaction, the seller gets their fees returned. Basically no disincentive to welch. Its better for everybody to report the seller rather than to let things go.
They cannot leave - feedback nor unpaid item claims either, so at least you get the satisfaction of greasing the seller if they stiffed you, and possible banning if they do this often enough.
Best of all, since he claimed the item is damaged, if he tries to list the item again as not being described as damaged, I'll report it again to ebay for fraud using his own words! hahahaha... what a [Richard-head].
Lesson is kids, don't welch, and don't then be a [Nixon] to the people you are trying to stiff.

Its great to be able to be all sugary sweet as the welcher slowly hangs himself and thinks he has done nothing wrong. And when all is said and done you still get to burn his a$$ in the end.
Sure, if dealing with a lesser person he might have gotten away with it. I'm sure he has in the past. But he'll think twice about next time I'm sure.
