Any chance this is a used (damaged) esc? I did a mod on a MM once and acidentally shorted one leg of thew fets (had a few move and didn't catch it :(, didn't kill the ESC before I found the problem but acted just like you are describing (cogging & excessive heat). Propably just the overvoltage thing but if draining the pack a bit does not help...

If I could only draw what I see in my head, then afford to build it, and finaly get to play with it...

Guys, feeling a bit dumb and may have prematurely posted. I updated the Castlelink software which THEN revealed a more recent firmware update and I loaded it. Cogging reduced to very brief pulse while it seeks the motor position. Still not nearly as good as a Quark but may be manageable. I am using a BEC. The thing gets hot, no doubt about it. It was a new ESC. My last CRT was designed for the chassis to heat sink everthing and nothing ever exceeded 35F over ambient so perhaps this heat is normal. I don't like normal though and will add a fan and/or mod the heat sink. Why oh why has it taken so long for a real 1/8th controller? Thanks for all those who gave feedback.
